ERISA Suit Filed Against Employer for Denial of Disability Benefits
Brady & O’Shea represented an employee who had become disabled while insured under a long-term disability policy. Our client was denied long-term disability benefits by his insurance carrier. Brady & O’Shea brought suit on his behalf against the insurance company in federal court in the Northern District of Iowa. The Court found that the insurance company had abused its discretion in failing to consider certain evidence related to our client’s disability and ordered that the insurance company reconsider their denial of benefits. After the Court’s ruling, the case settled for $260,000.
