Do I have a claim if I simply lost money because of a product, but did not suffer an injury from the product.

 

A: Yes. If you suffered an economic loss because a product did not perform in the manner that it was supposed to the purchase price (and possibly other damages) can often be recovered in claims for breach of warranty (even if there was no written warranty). Additionally, Iowa has recently enacted a law creating a private cause of action for consumer fraud. This law will allow some consumers to bring claims based on products that fail to adequately perform. These types of cases are often brought as class actions because there are many purchasers of the defective product and each purchaser's economic loss may not be high enough to justify an individual lawsuit.
