What is "negligence"?
A: Negligence means a failure to use ordinary care, that is the care that a reasonably careful person would use under similar circumstances. A person is negligent if they do something that reasonably careful person would not do, or fail to do something the reasonably careful person would do. In auto, motorcycle, and truck accidents, the court can find that one or more persons were negligent and contributed to causing the crash; damages are determined taking into account who was negligent and how negligent each person was.
