On September, 15, 2010 there was a press conference in Chicago, Illinois announcing that the first nationwide class action lawsuit was filed against Iowa-based farms Wright County Egg and Hillandale Farms. This class action suit represents the people who were injured or died from contaminated eggs.
Several of the injured class members were present at the press conference. This conference came one day following lab tests that still found salmonella contamination at both Iowa farms.
This has been the largest egg recall in history, and the lab tests have shown that hundreds of cases were found over a two-year period, prior to the egg recall. It has been confirmed that tests at Wright County Egg have proven 426 cases of salmonella contamination, and 73 were potentially positive for salmonella enteritidis (a strain of the disease from this year's outbreak). The time period the salmonella contamination was found reached as far back as September 2008 through July 2010.
The Food and Drug Administration inspectors found that Wright County Egg and Hillandale both did not pursue plans to avoid salmonella enteritidis. Investigators found salmonella bacteria in barn and walkway areas, chicken feed, manure, and in other places at the farms. These violations produced an environment that allowed hens to be infected with salmonella enteritidis.
The class action lawsuit accuses both Iowa farm companies of not complying with the Egg Safety rule and other state and federal laws.
