Fatal Cedar Rapids Crash Caused by Texting and Drunk Driving

Posted on Aug 24, 2011

We previously reported on a Cedar Rapids accident involving the death of a teenager that occurred in June 2011. There have been recent updates in this case that we wanted to inform our readers about.

This tragic accident that took place on Walford Road just east of 34th Street SW occurred around 3:15 a.m. when 19-year-old Drake D. Whitters, of Swisher, went off the road.

Passenger Jason M. Velvick, 16, of Swisher, did survive this rollover crash but was seriously injured.

Investigators announced Tuesday that the teen who died in this crash was legally drunk when he lost control of the car. Authorities also revealed that he was using his cell phone at the time of the crash.

Toxicology tests indicated that Whitter's blood alcohol level was 0.181, which is more than twice the legal limit. Also, tetrahydrocannabinol (THC), a chemical that is found in marijuana, was also found in his system.

Based on Whitter's cell phone records and Velvick's statements, authorities believe that he was attempting to read a text or composing a text at the time of the crash.

Texting while driving and drinking and driving are both causes of fatal crashes, but the combination of both certainly affected Whitter's chances of a deadly crash.

The Law Offices of Brady & O'Shea would like to extend our condolences to the family of Drake Whitters for strength during this difficult time.
