Iowa Employees Involved in Class Action Lawsuit with Wal-Mart Reached Settlement

Recently, a class action lawsuit in Iowa was settled involving Iowa employees of Wal-Mart Stores and Sam's Clubs who were involved in the Class Action lawsuit Mussmann, et al. v. Wal-Mart Stores, Inc.

However, before this case was settled, the Iowa District Court in Clinton County had to approve that the case be heard as a class action case in Iowa. The Court did hear the case and approved a settlement amount of $11 million.

Employees who worked at these stores in the state of Iowa from June 5, 1999 to May 9, 2009 could get a payment as part of the class action lawsuit regarding working conditions. The stores include: Wal-Mart Discount Stores, Supercenters, and Distribution Centers, and Sam's Club.

The lawsuit states that these Iowa-based stores failed to pay their hourly employees for all missed rest breaks and meal periods, even though the contract states that they pay their employees for this time. Hourly employees during this time period may have receive benefits if a claim had been submitted.

The settlement was finally reached, as Wal-Mart agreed to provide $11 million to compensate class members. On January 28, 2011, anyone who was part of this class action suit should have received payments, as the first and second distributions for class members were made. If a member did not opt-out of the settlement and if the correct address was on file, then a class member should have received their checks in the mail for their portion. The checks will be expiring at the end of April, as they are only good for 90 days.

The size of the payment to each class member depends on the length of time worked at one of these stores and the final number of class members involved in this suit.
