Linn County Jury Convicts Intoxicated Driver

In a case that involved difficult issues concerning legal causation, a Linn County jury in Cedar Rapids convicted a Hiawatha man of vehicular homicide. One of the most significant issues was whether the driver, Troy Fox of Hiawatha, Iowa, legally caused the death of passenger Ruben Mayo when the crash left him alive but unable to survive without life support services, which he chose to stop before his death.

The jury deliberated for five hours Friday before reaching a verdict. The crash occurred on Oct. 5, 2009 when Fox and lost control of his vehicle on Interstate Highway 380 and hit a light pole. Approximately a week later, Mayo decided to have life support withdrawn after he and his family learned from his physicians that he was permanently paralyzed below his neck and unable to breath without a ventilator.

Doctors, including Dr. Gerald Kealey, a well known University of Iowa trauma surgeon and director of critical services at University Hospitals, testified that Mayo would have spent the remainder of his life on a ventilator and remained paralyzed the mid-neck down, would never have control over his breathing, bladder and bowels and limbs, was at high risk of death from other complications, including kidney and lung injuries, and that his life expectancy was reduced to as little as four years. He could communicate only by blinking his eyes. In response to defense questions comparing Mayo to actor Christopher Reeves, who survived for 9 years after a similar injury before dying of adverse reaction to an antibiotic, Dr. Kealey noted that Reeves was an exceptional case who had "every resource available" and that he still died from his injuries despite numerous efforts to keep him alive. Dr. Kealey recently testified on behalf of a Brady & O'Shea client who suffered catastrophic, life altering injuries.
